Terms & conditions
In assigning documentation for translation and processing to MGO TRADUCCIONES (MGO), the customer enters a contract with this company to which the following terms apply:
1. Scope of these terms
These Terms of Service apply to all agreements or contracts made by MGO and its customers in the field of its professional work. Any other term applying to such contracts shall require express acceptance in writing from MGO.
2. Quotes
In general, all quotes are drawn up in writing, and confirmation of acceptance must be given by the customer. This acceptance may be sent to MGO by fax or by e-mail; if sent by e-mail, the acceptance will become valid when reception is acknowledged by this company. Verbal quotes or estimates for guideline purposes are not binding, and are subject to written confirmation being issued when the originals have been received and the relevant firm quote has been drawn up. Written quotes remain valid for 30 days.
3. Confidentiality
All translation projects are controlled under strict security and confidentiality rules. At the customer´s request, specific confidentiality agreements may be executed.
4. Computer virus
Users shall be responsible for keeping their systems free from computer virus. MGO shall take all steps to keep its systems free from virus infections. However, taking into account that new virus are being continuously introduced, MGO is in no position to guarantee that the files managed through this web site are free from virus, and shall not accept any responsibility or claims for loss or damage due to any eventual infection.
5. Prices
In general, translations are charged by words. For specific cases, a different charge system may be agreed (by lines or pages). All desktop publishing work, the inclusion of graphics and figures, layout work, working to specific formats, and all other cases in which applying prices by standard pages as in the case of translation work is not reasonable, shall be charged by the time spent. All ancillary expenses that are demonstrably connected with the performance of the work, such as telecommunications expenses or consultation and research expenses in excess of reasonable levels, and all courier expenses, shall be for the account of the customer. All prices are to be taken as not including VAT where that tax is applicable.
6. The intended purpose of the translation
Customers must clearly and expressly state the purpose for which they intend each translation. If this is not stated, the translation will be assumed to be solely for the information of the customer. Customers must state whether the translation is intended to be a definitive document for:
- Bids and tenders
- Contracts
- Patents and other legal purposes
- Printing or publishing
- Electronic publishing
- Or any similar destination.
If the translation assigned is subsequently used for a purpose other than the one stated by the customer when accepting the quote, confirmation must be sought from MGO that the translation is suitable for its new purpose, for otherwise no complaints or liability shall be accepted. MGO reserves the right to rework and adapt the translation submitted previously, if necessary, and to make the appropriate charge for these services. In the case of translations intended for publication, no complaints or liability shall be accepted unless the originals in their final version are sent to us for checking before publication.
7. Delivery of the work
If the customer prefers, the translation will be sent by fax, e-mail, FTP or by conventional mail, the date of delivery being the date shown by the transmitting fax in the first case, by the sending computer in the second, by the file date in the third, and by the post-office receipt in the fourth case, MGO not accepting liability for any delay arising as a result of overloads in the lines or servers, or other causes. MGO will do all necessary efforts to ensure that the documents have arrived at their destination, sending them again if problems have arisen.
8. Cancellations
If a customer wishes for any reason to cancel an assignment after confirming it and submitting the documentation to MGO, the customer will be charged for the amount of work already done, at the rates applying to that work. In the case of interpreter services, if the service is cancelled more than 15 days in advance, 50% of the amount due will be charged; if less than 15 days´ notice is given, the full amount will be charged. If an alternative contract can be agreed with the interpreter concerned, no charge will be made.
9. Interpreter service
Interpreting services are charged by the half-day or the full-day, in accordance with the time elapsing between the interpreter leaving our premises and his or her return. Any expenses incurred by the interpreter (travel and accommodation, per diems, preparation time etc.), which are always to be a matter for prior agreement, shall be for the account of the customer in all cases.
10. Payment
All invoiced charges are net and are to be paid when the work is delivered, plus VAT. Monthly accounts can be opened for customers so wishing, in which case payment is to be made before the 20th of the month following the month of invoicing.
11. Legal guarantee
The customer guarantees that the translation requested does not infringe copyright or other rights stemming from intellectual and industrial property, and that MGO shall not be held liable for any complaint from third parties.
12. Legistlation applying
All relations between the customer and MGO shall be governed by Argentine legislation. Any disputes arising shall be submitted to the Courts of the city of Buenos Aires.
